Information pursuant to Art. 13 General Data Protection Regulation (GDPR)

Purpose of data collection: We collect these data so that your chosen pharmacy can check your prescription and establish whether the medicine prescribed to you is available. In some individual cases it may also be necessary to establish contact between the prescribing doctor and the pharmacist involved.

 

Legal basis: The transmission of the data provided on your medical prescription (photocopy) and, if applicable, your telephone number to the pharmacy takes place on the basis of your consent in accordance with Art. 6, para. 1, sentence 1, lit. a GDPR or Art. 9, para. 2, lit. a GDPR.

 

Data recipient: We transmit your data only to your chosen pharmacy that participates in the project.

Data processing on the basis of consent:

 

As a matter of principle, we only collect data from you which is necessary for checking your doctor's prescription (content, correctness, completeness) through your chosen pharmacy, and for checking whether the medication prescribed to you is in stock in your chosen pharmacy. In addition, a consultation may take place between the pharmacist on emergency duty in the pharmacy of your choice and the prescribing physician if necessary to clarify an ambiguous prescription or to resolve any potential medication-related issues (in particular side effects or interactions). For these purposes, you have given your consent to such contact being established and to a waiver of the duty of confidentiality in favour of the prescribing doctor and the pharmacist involved before using the emergency column. For the purpose of quality assurance, the data of individual queries are statistically analyzed in anonymized form in order to improve the service provided with the emergency column. It is not possible to infer any conclusions about your person, in particular about the content of your query or the response from the pharmacy.

 

 

The transmission of the data provided on your doctor's prescription (photocopy of your prescription) and your telephone number to the pharmacies is carried out on the basis of your consent pursuant to Art. 6, para. 1, sentence 1, lit. a GDPR. Insofar as your consent relates to the processing of health data, which constitutes a special category of personal data pursuant to Art. 9, para. 1 GDPR, the processing shall be carried out on the basis of your consent pursuant to Art. 9, para. 2, lit. a GDPR. You may revoke your consent at any time without this affecting the lawfulness of the processing carried out to that moment. If the consent is revoked, we shall immediately stop the processing of the related data.

 

Optional provision of information:

 

The provision of your telephone number is optional. No negative consequences are associated with not providing this data. However, the non-provision of your telephone number means that you cannot be notified on your telephone via SMS whether the medication prescribed to you is available for collection in your chosen pharmacy. The same applies to further questions that the pharmacy may have. In these cases you can only be informed by a message displayed on the emergency column. This may mean that you will have to wait for the pharmacy to notify you via the emergency column.

 

Data Recipients:

 

We will only transmit your data to the pharmacy participating in the project that you have selected via the emergency column. A general overview of the pharmacies participating in the project can be made available upon request.

 

In addition, it is possible that our external service provider, mediQuu UG (limited liability) & Co. KG, Hafenweg 26a in 48155 Münster, who is strictly bound by instructions and who is entrusted by us with the technical support of the emergency columns within the scope of an order processing contract, may gain knowledge of your personal data. Other than that, this data shall not be transmitted to third parties or processed for any other purposes. Also, no data processing outside the EU will be carried out.

 

Deletion of data:

 

The data provided by you (photocopy of the prescription, your details) will be saved on the emergency column only as long as necessary for the transmission of the prescription to your chosen pharmacy. Your data will then be deleted from the emergency column. The data you enter will be saved electronically in your chosen pharmacy so that your prescription can be delivered. The participating pharmacies are instructed to delete the electronically saved data once the order has been delivered. In addition, an automated deletion of your data in the pharmacy at the end of the emergency duty (approx. 30 minutes after the end of the emergency duty) is ensured.

Rights of the Data Subject

 

Data subjects have the right to obtain information from the Data Controller concerning their personal data and to have inaccurate data corrected or deleted, in the event that one of the reasons stated in Art. 17 GDPR applies, e.g. if the data is no longer required for the intended purposes. Moreover, the right to restriction of processing exists if one of the conditions specified in Art. 18 GDPR applies, and in the cases specified in Art. 20 GDPR, the right to data portability exists.
